- The U.S. Department of Labor’s proposed regulations relating to:
- Increasing the minimum salary threshold for those employees that are classified as exempt from the FLSA overtime requirements to $35,308 (from $23,660)
- Clarifying what pay items must be included in (i.e., non-discretionary bonuses and shift differentials) and what pay items can be excluded (i.e., wellness program awards and discretionary bonuses) from the regular rate for purposes of calculating overtime wages
- Potentially narrowing the scope of liability for companies in franchise relationships or temporary staffing arrangements
- The U.S. Department of Labor’s current position on tip pools and the 80/20 rule
- The most common types of wage and hour claims (Invalid tip pools, misclassification issues, off the clock issues, miscalculation of overtime, and claims under the Illinois Biometric Information Privacy Act)
- Amendments to the Illinois Minimum Wage Law which drastically increase penalties for failure to pay minimum and overtime wages
